Who We Are

ZTAG, Inc. (“ZTAG,” “we,” “us”) designs and manufactures active learning systems — wearable devices (“ztaggers”) and a central control unit (Z.U.E.S.) — that get students moving, playing, and learning together.

These Terms govern (a) your use of ztag.com and (b) your purchase and use of ZTAG hardware systems and the firmware/software that runs on them.

Student Privacy — Our Position

ZTAG does not collect, store, or transmit personally identifiable information (PII) about students.

Our devices record aggregate gameplay metrics — such as step counts, interaction events, and game outcomes. These metrics are not linked to individual student names, accounts, or rosters. ZTAG does not maintain student accounts. Devices are shared across users between sessions.

Because ZTAG does not collect student PII:

  • COPPA, FERPA, and SOPIPA obligations applicable to student data do not apply to ZTAG hardware or firmware.
  • We cannot disclose student data to third parties because we do not have it.
  • Schools and program operators retain full control over which students use which devices.

A note on device assignment. Each ztagger has a unique device ID used internally for gameplay coordination. If a school assigns the same ztagger to the same student every day over a long period, that device ID could become indirectly associated with that student. To preserve the privacy-by-design model, we recommend rotating ztagger assignment across students rather than fixed 1:1 assignment. ZTAG does not enforce or monitor assignment patterns.

Your Use of ztag.com

You may browse, read, and share content from ztag.com for personal, educational, or business purposes. You may not:

  • Scrape the site at scale or in a way that disrupts service
  • Reverse-engineer the site or its underlying systems
  • Misrepresent yourself as ZTAG or affiliated with ZTAG
  • Use the site to distribute malware or to harass others

We may update site content at any time without notice.

Hardware Purchase

When you purchase a ZTAG system, you own the hardware outright. There is no subscription, no remote disablement, and no requirement to maintain a connection to ZTAG servers for the system to function.

Warranty. ZTAG hardware carries a 12-month manufacturer warranty from the date of delivery, covering defects in materials and workmanship. The warranty excludes damage from misuse, liquid exposure, drops, unauthorized modification, or normal wear. Safety-related defects (including battery, electrical, or thermal issues) are covered regardless of warranty period or apparent cause of damage; please contact us immediately if you observe any such issue.

Extended care. Coverage beyond 12 months is available as a separate purchase under separate terms.

Returns. New, unused systems may be returned within 30 days of delivery for a full refund less return shipping. Used systems are non-refundable but covered by the warranty above.

Firmware and Software License

The firmware on ZTAG hardware and any software ZTAG provides with a system (collectively, “ZTAG Software”) is licensed, not sold.

ZTAG grants you a perpetual, non-exclusive, non-transferable license to use the ZTAG Software on the ZTAG hardware you purchased, for educational, recreational, and program-delivery purposes. You may run, configure, and customize game settings exposed through the standard interface.

You may not:

  • Copy or redistribute the ZTAG Software outside your organization
  • Reverse-engineer, decompile, or disassemble the ZTAG Software, except where applicable law expressly permits
  • Remove ZTAG branding or copyright notices
  • Use the ZTAG Software to develop a competing product

ZTAG retains all rights, title, and interest in the ZTAG Software, including all source code, designs, patents, and trademarks.

Software updates. ZTAG provides firmware and software updates to current customers at no additional charge. We may add features, fix bugs, or modify gameplay over time. Updates are delivered as-is; we will not remotely disable functionality you depend on.

Future services. ZTAG may offer additional optional services in the future (for example, online content libraries or cloud-based features) under separate terms. Nothing in these Terms commits ZTAG to providing such services or commits you to purchasing them.

Customer Identification

ZTAG may identify customer organizations (schools, districts, after-school programs, partners) by name and logo on ztag.com, in marketing materials, and in case studies. If your organization prefers not to be listed, email support@ztag.com and we will remove the reference within 30 days.

Acceptable Use

You agree not to use ZTAG hardware or software:

  • In a way that creates safety risk to participants
  • For any unlawful purpose
  • To collect personal information from students using ZTAG as a vector

Schools and program operators are responsible for supervising gameplay and complying with applicable local rules.

Disclaimers and Limits

ZTAG hardware and software are provided “as is” except for the express warranty in Section 4. To the maximum extent permitted by law, ZTAG disclaims all other warranties, express or implied, including merchantability and fitness for a particular purpose.

ZTAG’s total liability arising from these Terms or your use of ZTAG products is limited to the amount you paid for the affected hardware in the 12 months preceding the claim. ZTAG is not liable for indirect, consequential, or incidental damages.

Nothing in these Terms limits liability for fraud, willful misconduct, or any liability that cannot be limited under applicable law.

Changes to These Terms

We may update these Terms from time to time. The current version will always be posted at ztag.com/terms-of-service with an effective date. Material changes affecting hardware customers will be communicated by email to the address on file.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California.
